Terms of Service

Welcome to EverChat. These Terms of Service (“Terms”) govern your access to and use of the EverChat website and realtime chat service (the “Service”). By creating an account, signing in, posting a message, or purchasing ad space, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use EverChat

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. You are responsible for keeping your sign-in credentials secure and for all activity under your account.

2. Your content

You retain ownership of the messages, profile details, avatars, and any other content you submit (“User Content”). By posting User Content, you grant EverChat a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit that content for the purpose of operating and providing the Service. You are solely responsible for your User Content and represent that you have the rights to post it.

3. Acceptable use

You agree not to use the Service to:

  • post unlawful, harassing, hateful, defamatory, or sexually exploitative content;
  • spam, flood, or send unsolicited advertising outside of purchased ad placements;
  • impersonate any person or misrepresent your affiliation with anyone;
  • infringe intellectual-property or privacy rights of others;
  • distribute malware, or attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
  • scrape or harvest data except as expressly permitted.

4. Moderation

We may review, moderate, remove, or restrict any content or account at our discretion, including content that violates these Terms. Channels may have moderators with additional controls. You can block other users, and you can report content to us at support@ever.chat. We are not obligated to monitor all content but may do so.

5. Ad space purchases

EverChat sells advertising placements in channels. When you purchase an ad, you agree that:

  • the price shown at checkout, computed from the size and run length you select, is the amount you will be charged;
  • your ad content must comply with the acceptable-use rules above, and we may reject or remove ads that do not;
  • ad placements run for the duration purchased and are not guaranteed a specific number of impressions or clicks;
  • fees are generally non-refundable except where required by law or where we remove a compliant ad through our own fault.

6. Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms; if we make material changes we will update the “Last updated” date and, where appropriate, provide additional notice. Continued use after changes take effect constitutes acceptance.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the maximum extent permitted by law, EverChat and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) will survive.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the EverChat operator is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction.
